1. Agreeing to these terms

These Terms of Service (“Terms”) are an agreement between you and Divinetrades Technologies LLC, a Pennsylvania limited liability company (“DivineTrades”, “we”, “us”). They cover your use of the DivineTrades website, trading journal and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

2. Who can use DivineTrades

You must be at least 18 years old and able to enter a binding contract. You may not use the Service if the law where you live forbids it, or if we have previously closed your account for breaking these Terms. By using the Service, you confirm that all of this is true.

3. Your account

• Give us a real email address that you can access, and keep it up to date.
• Keep your password secret and don’t share your account. You are responsible for what happens under your account.
• One account per person. Don’t create accounts with bots or automated tools.
• Your username must not pretend to be someone else, including DivineTrades staff, and must not be offensive. We may change or remove a username that breaks these rules.
• Tell us straight away at support@divinetrades.io if you think someone else has accessed your account.

4. What DivineTrades is

DivineTrades is a tool for keeping a private journal of your own trading: your plans, trades, notes, screenshots, moods, rules and reviews, with game features (XP, levels and rewards) that encourage good journaling habits. It may also show general information, such as an economic calendar. DivineTrades is not a broker, does not hold your money, does not place trades, and is not connected to your brokerage accounts.

6. Your content

Your journal is yours. You keep all rights to what you write and upload (“your content”). To run the Service, you give us a limited, worldwide, non-exclusive, royalty-free permission to store, copy, process and display your content only to provide the Service to you (for example, saving it, showing it to you, making backups and counting your XP). This permission ends when your content is deleted, apart from routine backups that are overwritten over time.

You confirm that you have the right to upload your content, and that it doesn’t break the law or anyone else’s rights. Don’t upload other people’s personal information without permission. You can download a full backup of your content at any time in Data & Backup.

7. Rules of use

You agree not to:

• break the law, or use the Service for anything illegal or fraudulent;
• try to access anyone else’s account or data, or get around our security, sign-in, bot check or storage limits;
• cheat the game features, for example by changing saved dates, sending fake data to our servers, or using bugs to gain XP, levels or rewards;
• attack, overload, scan or disrupt the Service, or use bots, scrapers or automated tools on it without our written permission;
• copy, sell, rent or resell the Service, or reverse engineer it except where the law allows;
• upload viruses or harmful code, or content that is unlawful, abusive, hateful, sexually explicit or that infringes someone’s rights;
• pretend to be DivineTrades or someone else.

If you find a security problem, please tell us privately at support@divinetrades.io instead of using it.

8. XP, levels and rewards

XP, levels, streaks, badges and similar features are for motivation and fun. They have no cash value, can’t be sold, traded or exchanged for money, and aren’t your property. We may change how they are counted, fix mistakes, and remove ones gained by cheating or bugs.

9. Free and paid plans

The Service is currently free. We may offer paid plans or features in the future. If we do, the price, what’s included, how billing and renewal work, and how to cancel will be shown clearly before you buy, and you’ll be able to cancel at any time in Settings. Any extra terms for paid plans will be shown to you and will form part of these Terms. We will never charge you without your clear agreement.

10. Our content and brand

The Service itself — its software, design, artwork, text, characters and the DivineTrades name and logo — belongs to DivineTrades or our licensors and is protected by law. We give you a personal, non-transferable, revocable permission to use the Service for your own trading journal, following these Terms. You may not use our name or logo without our written permission. If you send us ideas or feedback, we may use them freely without paying you.

11. Ending your account

You can leave at any time. Go to Settings → Privacy & account → Delete my account. Your account is locked straight away and permanently erased after 7 days, unless you sign in and keep it before then. See the Privacy Policy for details.

We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect other users or the Service. Where reasonable, we’ll tell you first and give you a chance to download your content. If we ever shut down the Service entirely, we’ll give you reasonable notice so you can download your content.

Sections 5, 6 (your confirmations), 8, 10, and 13 to 18 continue to apply after your account ends.

12. Beta features and changes

DivineTrades is still growing. Some features are labelled “beta” or “test” and may change, break or be removed. We may update, change or stop parts of the Service at any time. Please keep your own backups of anything important (Data & Backup → Full backup).

13. No warranties

To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that the Service will always be available, error-free or secure, that data will never be lost, or that any information in it (such as calendars or statistics) is accurate or complete. Some places don’t allow these exclusions, so some of them may not apply to you.

14. Limitation of liability

To the fullest extent the law allows:

• DivineTrades and its owners, members, managers, employees and partners will not be liable for any trading or investment losses, lost profits, lost data, or any indirect, incidental, special, consequential or punitive damages, arising from or related to the Service, even if we were told they were possible;
• our total liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) US $100.

Nothing in these Terms limits liability that can’t be limited by law, such as liability for fraud or for gross negligence or willful misconduct where the law doesn’t allow it to be limited.

15. Indemnity

If you break these Terms or the law, or your content infringes someone’s rights, and this leads to a claim against DivineTrades, you agree to cover our reasonable losses and costs (including reasonable legal fees) from that claim, to the extent the law allows.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-law rules. If you have a problem, please email us first at support@divinetrades.io — most issues can be sorted out quickly that way. If we can’t resolve it within 30 days, any legal claim must be brought only in the state courts located in Lackawanna County, Pennsylvania, or the United States District Court for the Middle District of Pennsylvania, and you and we agree to the jurisdiction of those courts. Either of us may bring a qualifying claim in small-claims court instead. If you live in a country whose laws give you the right to bring claims in your local courts or to rely on local consumer protection rules, these Terms don’t take that right away.

17. Changes to these terms

We may update these Terms from time to time. We’ll change the “Last updated” date above, and if a change is important, we’ll tell you by email or in the app at least 14 days before it takes effect (unless it is needed sooner for legal or security reasons). If you keep using the Service after a change takes effect, you accept the new Terms. If you don’t agree, you can delete your account.

18. General

• These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
• If any part of these Terms can’t be enforced, the rest still applies.
• If we don’t enforce a part of these Terms straight away, we can still enforce it later.
• You may not transfer your account or these Terms to anyone else. We may transfer them as part of a merger, sale or reorganization of our business.
• We aren’t responsible for delays or failures caused by events outside our reasonable control, such as outages at our providers, internet failures or natural disasters.
